Terms of service

1. The agreement

Wheely is operated by Burt Lao. By making an account or using the site, you agree to these terms. If you do not, please do not use it. If you are agreeing on behalf of an organisation, you are confirming that you are allowed to.

2. Your account

You need to be at least 13 to have an account. One person, one account, and the details you give should be accurate. Keep your password to yourself: anything done through your account is treated as done by you, so tell us promptly if you think somebody else is in it.

Some things need a confirmed email address first, namely subscribing, publishing a wheel, turning on a share link and inviting people to a team. Making, editing and spinning your own private wheels does not.

3. What you may not do with it

Use Wheely for whatever you like, except:

• Anything illegal, or anything that infringes somebody else's rights.
• Publishing content that is hateful, harassing, sexual involving minors, or that exists to bully a named person.
• Uploading other people's personal information, or pictures you have no right to use.
• Breaking into, overloading, or probing the service, or working around the limits of your plan.
• Scraping the site wholesale, or re-selling access to it as though it were yours.

Published wheels can be reported, and a wheel that breaks these rules can be unpublished or removed.

4. What you make stays yours

Your wheels, your slices and your uploads remain yours. Wheely claims no ownership of them.

To actually run the service we need permission to do the obvious things with them: store them, back them up, and show them to you. When you publish a wheel or turn on a share link, you are additionally allowing us to show it to the people you shared it with, to display it in Explore, to let others copy it into their own account, and to generate a preview image of it for links and search results. That permission ends for future use when you make the wheel private again or delete it, though copies other people already made remain theirs.

The built-in template wheels are ours. You are welcome to copy them into your account and change them however you like, which is what they are for.

5. Plans and payment

The free plan is genuinely free and needs no card. The Pro plan is billed yearly in advance. The current price and what each plan includes are on the pricing page, which is the authority on both.

Payments are taken by Stripe, and by subscribing you accept their terms as well. Prices are exclusive of any tax that applies where you are, unless it says otherwise at checkout.

A subscription renews automatically each year until you cancel. We will tell you before the price of an existing subscription changes, and you will have the chance to cancel before it takes effect.

6. Cancelling, refunds, and what happens to your wheels

You can cancel whenever you like from your billing page. Cancelling stops the next renewal: you keep Pro until the end of the period you have already paid for, and you are not charged again.

Payments already made are not automatically refunded, since you have had the year you paid for. If something went genuinely wrong, ask through contact@screentext.net and we will sort it out. Where the law where you live gives you a right to cancel and be refunded, that right stands regardless of this paragraph.

When Pro ends you drop to the free plan, and this is the part worth reading twice. Nothing is deleted, but the free plan's limits apply again, and two of them bite: a wheel with more slices than the free plan allows, and a wheel that still has pictures on its slices, cannot be saved again until it is brought back within those limits. You can still open, spin and export such a wheel, and the editor keeps the button that removes the pictures. Wheels beyond the free plan's published limit stop being public. Export anything you care about before you cancel.

7. Availability

We try to keep Wheely up and working, and it will still sometimes be down for maintenance or for reasons outside our control. There is no guaranteed uptime figure attached to either plan. Features change over time; if we remove something significant that a paid plan was sold on, we will tell subscribers.

8. Spins, chance and prizes

The wheel picks by chance, weighted as you set it. It is built for picking names, chores, and what to have for dinner. It is not a gambling service, it is not certified as a random number generator for any regulated purpose, and results are not guaranteed to be suitable where the law demands a certified draw. If you run a competition, giveaway or prize draw with it, complying with the rules that apply to that is entirely down to you.

9. Ending it

You can stop using Wheely at any time and ask for your account to be removed. We can suspend or close an account that breaks these terms, and, other than for a serious breach, we will tell you why and give you a chance to put it right first. If we close a paid account without cause, we will refund the unused part of the period you paid for.

10. Warranties and liability

Wheely is provided as it is. Beyond what the law requires of us, we do not promise that it will be uninterrupted, error free, or fit for a particular purpose of yours.

We are not liable for indirect or consequential losses, or for lost profits, revenue or data. Where liability cannot be excluded, it is limited to the amount you have paid us in the twelve months before the claim, which for a free account is nothing.

Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that the law does not allow to be limited. If you are a consumer, your statutory rights are unaffected by any of this.

11. Changes to these terms

These terms can change. The date at the top changes when they do, and for a change that materially affects you we will give notice before it takes effect rather than expecting you to re-read the page. Continuing to use Wheely after that is how you accept the new version.

12. Law and disputes

These terms are governed by the laws of the State of California, United States, and disputes go to the courts there. If you are a consumer living somewhere else, you keep the protection of the mandatory laws of your own country and can bring a claim there.
